Social Security Disability Claims
Baton Rouge and Gonzales, Louisiana
To qualify for disability benefits under Social Security,
the Federal Social Security Disability Act states that you
must be unable “to engage in any substantial gainful activity
by reason of any medically determinable physician or mental
impairment which can be expected to last for a continuous
period of not less than 12 months or result in death."
There are five primary types of Social Security Disability
Claims and Benefits.
- Disability Insurance Benefits: Social Security
disability benefits are paid to individuals who have worked
five of the last 10 years and are now disabled.
- Disabled Widow's and Widower's Benefits: paid
to individuals at least 50 years of age and have become
disabled within a certain amount of time following the
death of their spouse. The deceased spouse must have worked
enough under Social Security to be insured.
- Disabled Adult Child Benefits: paid to the children
of persons who have died or who are drawing Social Security
disability or retirement benefits. The child must have
become disabled before age 22.
- Supplemental Security Income Benefits: paid to
individuals who are poor and disabled. Past work history
does not matter.
- Supplemental Security Income – Child's Disability
Benefits: a variety of SSI benefits paid to children
under the age of 18 who are disabled. The way in which
disability is determined is a bit different for children.
